What are Civil Proceedings?

Civil proceedings are all proceedings which are not criminal proceedings. Family proceedings are also a type of civil proceeding.  Below are some of the types of civil proceedings which may be commenced in the courts of the Falkland Islands.

 

Admiralty

Shipping & Maritime disputes

Bankruptcy

A way for an individual to manage debts they cannot pay.

Contractual Disputes

When parties to a contract wish to enforce parts of the contract and they cannot come to an agreement.

Companies Act

Proceeding brought under the applicable legislation relating to companies.

Financial Claims <£50,000

Financial claims of fixed or unfixed amounts. This may include debt recovery or claims for personal injury.

Financial Claims >£50,000

Financial claims of fixed or unfixed amounts. This may include debt recovery or claims for personal injury.

Judicial Review

Proceedings to challenge a decision made by a public authority.

Land

Claims relating to land are heard before the Supreme Court. This may include matters such as boundary disputes or an application for a fresh title to land.

Civil appeals to the Senior Magistrate/Magistrate's Court

Under the law of the Falkland Islands, there are various civil appeals which lie to the Senior Magistrate or the Magistrate's Court.  Some of these can be found in;

  • Prohibited Goods Ordinance
  • Electoral Ordinance
  • Licensing Ordinance
  • Firearms & Ammunition Ordinance
  • Dangerous Goods Ordinance
